Tanishq E-Gift Card

General

This “Tanishq USA” Gift Card (“Gift Card”) is issued by TCL North America Inc. (“TCL NA”) and is subject to the following Terms and Conditions. By purchasing or using a Gift Card, you agree to be bound by these Terms as well as TCL NA’s online Terms of Use and Privacy Policy.

I. Purchase, Validity, and Redemption

1. Purchase

• Gift Cards can be purchased as physical cards or e-gift cards in values ranging from $100 to $2,000.
• A maximum of $10,000 in Gift Cards can be purchased per person per day and no more than $2,000 can be associated with an individual Gift Card, or other prepaid access device or vehicle on any day.

2. Redemption

• (a) Gift Cards are redeemable at Tanishq USA retail locations or online at www.tanishq.com .
• (b) Gift Cards may only be used for Tanishq jewelry products within North America. The gift cards can be redeemed only against jewelry products and cannot be used to purchase gold coins or gold bars.

3. Tax and Balances

• (a) No sales tax is charged at the time of purchasing a Gift Card. Applicable sales tax will be applied to purchases made with the Gift Card.
• (b) If a purchase exceeds the available balance, the remaining amount must be paid using another acceptable payment method.
• (c) Any unused balance will remain on the Gift Card for future purchases unless otherwise required by law.

4. Returns

• Purchases made using the Gift Card are subject to TCL NA’s Return and Exchange Policy.

II. Features and Restrictions

1. No Expiration:

• o Unless otherwise required under applicable laws, there is no expiration for this Gift Cards and are not subject to dormancy or maintenance fees.

2. Prohibited Uses

• (a) Gift Cards cannot be used to purchase other Gift Cards.
• (b) Gift Cards may not be resold, exchanged for cash, or reloaded unless required by applicable law.

III. Fraud Prevention

• (a) TCL NA reserves the right to void Gift Cards suspected of being obtained fraudulently or misused.
• (b) Misusing Tanishq trademarks, logos, or intellectual property in connection with Gift Cards is strictly prohibited.

IV. Risk of Loss

• (a) TCL NA will not be liable and will not replace or reimburse the value of the Gift Card if it is lost, stolen, damaged, defaced or used without permission.
• (b) Risk of loss and ownership of Gift Card pass to the purchaser at the time of purchase.

V. Balance Inquiries

• (a) Check your Gift Card balance by visiting a Tanishq retail location or www.tanishq.com .
• (b) Balance inquiries are estimates and may be updated following recent transactions.

VI. Limitation of Liability

• (a) TCL NA makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose regarding Gift Cards.
• (b) TCL NA’s sole liability for non-functional Gift Card is replacement with a card reflecting the recorded balance upon completion of fraud prevention verification.
• (c) TCL NA is not responsible for indirect, special, or consequential damages arising from the use of Gift Cards.

VII. Dispute Resolution

These Terms and Conditions shall be construed in accordance with the laws of the State of New York. Disputes, if any, will be subject to exclusive jurisdiction of the courts in New York and any objections based upon venue are hereby waived. The United Nation convention on Sale of Goods is expressly excluded from application.

VIII. Changes to Terms and Governing Law

• Tanishq reserves the right to amend these Terms at any time without prior notice. The most current version is available at www.tanishq.com/gift-card-terms-and-condition.html .
• These Terms are governed by the laws of the United States. Disputes will be resolved through arbitration as specified in these Terms.
